These Terms and Conditions shall apply and form part of the contract between Konstancja Suchanek Norsk Hjemme (“We”, “Us” and “Norsk Hjemme”) and its Users (as defined below) in relation to the User’s registration, attendance, and/or use of the Site and/or the Services. By using and/or accessing our Site, you, as a site visitor, also agree to be bound by the following Terms and Conditions.
1. Interpretations and Definitions
1.1. In these Terms and Conditions, the words and expressions set out below shall have the following meanings:
“Business Days” means a day (except Saturday) on which banks are open for general banking business in Poland;
“Instructor” means the individual assigned by Norsk Hjemme to teach the Group Courses and Individual Lessons;
“Language Courses” means the online language courses offered by Norsk Hjemme as set out in Section 2.1 below;
“Services” means the services offered by Norsk Hjemme, namely, the online Language Courses and translation services set out in Section 2 below;
“Site” means our website located at https://norskhjemme.com;
“Translation Services” means the translation services offered by Norsk Hjemme as set out in Section 2.2 below; and
“User” or “Users” means an individual who has registered for our Services.
2. Our Services
2.1. Language Courses: Norsk Hjemme offers three different online language curriculums for individuals who wish to learn and/or improve their Norwegian language skills:
(i) Interactive Courses
a. Upon successful registration and payment, Users will be granted access to complete a set of interactive exercises hosted on our Site which is aimed at improving the User’s vocabulary, grammar, and overall fluency.
(ii) Group Courses
a. Group courses consist of 50 classes to be taught over the course of 25 online sessions;
b. Each session will be 1½ hours broken down into two 45-minutes classes with a 15-minute break in-between.
(iii) Individual Lessons
a. Individual lessons consist of private one-on-one lessons with your designated course Instructor; and b. Each lesson will be 45-minutes long.
2.2 Translation Services: Norsk Hjemme offers the following translation services:
(i) Norwegian to English, English to Norwegian; and
(ii) Norwegian to Polish, Polish to Norwegian (“Translation Services”).
3. Registration for Language Courses
3.1 Registration for our Language Courses can be made online via our Site, e-mail, social media platforms, or through our affiliate partners. Before successfully enrolling in the Language Courses, the User shall have the option of attending a 15-minute consultation with one of our Instructors who will assess the User’s level and fluency. The Instructor will then allocate the User to the appropriate course level.
3.2 Upon allocating the User to the appropriate course level, the User will be provided with the relevant course details and payment instructions.
3.3 A course confirmation e-mail will be issued to the User upon successful registration and payment of the Language Course.
4. Submissions for Translation Services
4.1. All submissions for our Translation Services shall be made online through our Site or by e-mail by uploading or submitting the material to be translated (“Materials”) and by indicating the expected delivery time, which will be one of three options: (i) Standard – within 7 Business Days, (ii) Express – within 3 Business Days, or (iii) Urgent – within 24 hours.
4.2. After reviewing the Materials and the requested delivery time, a fee quote will be provided to the User for the translation assignment.
4.3. If Norsk Hjemme has not received the full Materials required to complete the translation, Norsk Hjemme will promptly notify the User. In such cases where the full Materials had not been delivered by the User, Norsk Hjemme reserve the right to seek an extension of the delivery date and compensation for any expenditures incurred.
4.4. If the User requests for amendments or changes to be made to a translation, Norsk Hjemme reserve the right to charge for such alteration work except where such amendments are required by reason of objective defects in the translation delivered.
4.5. Norsk Hjemme also reserves the right, in its sole discretion, to decline any translation assignment without having to set forth its reasons.
5. Fees and Payment
5.1. The fees listed on our Site for the Services are in Euros and are subject to change at any time. Prices for our Translation Services shall be subject to the delivery time and complexity. Norsk Hjemme will confirm the fees with the User by e-mail after the User’s registration and/or submission for the Services.
5.2. Payment for the Services shall be made via bank transfer, or by credit/debit card. The information for payment will be provided to the User upon successful registration or submission for our Services.
5.3. Failure by the User to pay on time and/or if Norsk Hjemme is unable to receive, in a timely fashion, the User’s payment by no fault of its own, will entitle Norsk Hjemme, in its discretion, to cancel and/or terminate its Services to the User.
6. Course Attendance
6.1. The Users are fully responsible for their attendance of the Language Courses. No make-up lessons or refunds are available should the User fail to attend the Group Courses or Individual Lessons as scheduled, including without limitation, where the User’s inability to attend is due to technical failures of their own such as a faulty Internet connection, defective computer system, and power outage. It is the User’s sole responsibility to ensure that they have access to suitable IT equipment and Internet connection before the commencement of the Group Courses or Individual Lessons.
6.2. Access to the Interactive Courses is subject to time limitations which the Users are notified and informed of in writing in advance. Once the time limit for the Interactive Course expires, Users will no longer be entitled to access said Interactive Course. It is the Users’ sole responsibility to ensure that they complete the Interactive Courses within the designated time period before their access expires.
6.3. The Language Courses are intended for, and participation is restricted exclusively to, the User. The User is not entitled to transfer the Language Course nor substitute his/her attendance with another individual, regardless of whether such individual is also a User of our Services. In the event that an unauthorized individual is discovered to be attending the Language Course in place of the User, Norsk Hjemme shall be fully entitled to prohibit or ban the individual from accessing our Services, and we may, in our discretion, terminate our Services to the User without notice.
6.4. In the course of their attendance of the Language Courses, the User represents and warrants to Norsk Hjemme that he/she will not:
(i) Make any audio or video recordings of the Language Courses, and/or distribute the same to third parties;
(ii) Disrupt or interfere with the lessons by broadcasting and/or allowing loud background noise to broadcast during the Language Course;
(iii) Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity) of other Users;
(iv) Use racially, ethnically, or otherwise offensive language;
(v) Discuss or incite to illegal activity;
(vi) Use explicit/obscene language or solicit/post sexually explicit images (actual or simulated);
(vii) Post any copyrighted or trademarked materials without the express permission from the owner; and
(viii) Disseminate any unsolicited or unauthorized advertising, promotional materials, ‘junk mail’, ‘spam’, ‘chain letters’, ‘pyramid schemes’, or any other form of such solicitation.
6.5. A failure by the User to comply with Section 6.4 shall entitle Norsk Hjemme to remove the individual from the Language Course, with or without notice.
7. Rescheduling, Cancellations, and Refunds
7.1. Users who are enrolled in the Individual Lessons may request for their lesson to be rescheduled or postponed at no additional fee by giving their Instructor no less than 24 hours advance notice. No rescheduling or postponement requests will be entertained with respect to Group Courses.
7.2. Norsk Hjemme reserves the right to reschedule or cancel a Language Course at any time and for any reason. Norsk Hjemme will endeavor to inform its Users of the cancellation or reschedule at its earliest convenience, and in such case, offer the User a new course date that is reasonably convenient for the User.
7.3. No refunds are available for the Language Courses and Translation Services.
8. Electronic Communications
By using our Services, the Users consent to receiving electronic communications from Norsk Hjemme. These electronic communications may include notices about applicable fees and charges, transactional information, and other information concerning or related to the Services. These electronic communications are part of your relationship with Norsk Hjemme. The Users agree that any notices, agreements, disclosures, or other communications that we send to the Users electronically will satisfy any legal communication requirements, including that such communications be in writing.
9. Confidentiality
9.1. In the course of providing our Services, Norsk Hjemme may receive access to confidential information from the Users. Confidential information shall not be deemed to include information that:
(a) is or becomes publicly known other than through any act or omission of the receiving party;
(b) was in the other party’s lawful possession before the disclosure;
(c) is lawfully disclosed to the receiving party by a third party without restriction on disclosure; or
(d) is independently developed by the other party, which independent development can be shown by written evidence.
9.2 We shall hold such confidential information in strict confidence and we shall not use the confidential information for any purpose other than to perform the Services, unless disclosure is otherwise required by law, any governmental or other regulatory authority, or by a court or other authority of competent jurisdiction, provided that, to the extent, it is legally permitted to do so, it gives the other party as much notice of such disclosure as possible.
10. Third Party Sites
This Site may contain links to third-party sites and or pages that will allow you to interact and/or conduct transactions with such third-party sites. If you decide to access any of these third-party sites, you agree and acknowledge that you do so at your own risk. Norsk Hjemme does not verify, make any representations, or assume any responsibility for such third-party sites, including, without limitation, the truthfulness, accuracy, quality, or completeness of the content, services, links displayed, and/or any other activities conducted on or through such third-party sites. These Terms shall not cover your interaction or usage of any third-party sites.
11. Intellectual Property Rights
11.1 All trademarks, names, and logos on this Site are the property of their respective owners. Unless otherwise specified in these Terms, all information and screens appearing on this Site, including documents, services, site design, text, graphics, logos, images, and icons, as well as the arrangement thereof, are the sole intellectual property of Norsk Hjemme or its licensor.
11.2 All intellectual property rights in or arising out of or in connection with the Language Courses, including without limitation, any recordings and course materials distributed for the Group and Individual Lessons, shall remain the property of Norsk Hjemme or its licensor.
Except with the express permission of Norsk Hjemme, any distribution, modification, retransmission, or publication of any copyrighted material belonging to Norsk Hjemme or its licensor is strictly prohibited.
12. No Relationship
Nothing in these Terms creates a relationship of agent and principal, partners, joint ventures, or employer-employee between the Users and Norsk Hjemme, and no act or obligation of either party will in any way bind the other.
13. User Representation and Warranties
13.1. As a condition of the User’s use of our Services, the User represents and warrants to Norsk Hjemme that:
(a) The User will not use the Services for any purpose that is unlawful or prohibited by Norsk Hjemme under these Terms and Conditions;
(b) All the information that is provided by the User to Norsk Hjemme is, to the best of the User’s knowledge, true and accurate;
(c) The User will not misrepresent or attempt to misrepresent your identity while using Norsk Hjemme’s Services; and
(d) The User will not attempt to gain unauthorized access to the Site, or to obtain any materials or information stored on the Site through any means not intentionally made available through the Site.
13.2 Norsk Hjemme reserves the right to remove or disable access of its Services to any User who has breached the conditions under Section 13.1 above, with or without notice.
14. Disclaimers
Norsk Hjemme, for itself and its affiliates, licensors, agents, representatives, third-party services providers, and any of the foregoing entities’ respective officers, directors, owners, employees, agents, partners, contractors, representatives, successors, and assignees makes no express, implied or statutory representations, warranties, or guarantees in connection with this Site and the Services, relating to the quality, suitability, truth, accuracy or completeness of any information or material contained or presented on this Site or provided through our Services. Unless otherwise explicitly stated, to the maximum extent permitted by applicable law, this Site, the Services, and any information or material contained or presented in the course of our Services are provided to you on an “as is,” “as available” and “where-is” basis with no warranty of implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.
15. Limitation of Liability
15.1 You agree and acknowledge that your use of this Site and/or our Services is at your own risk. To the extent permitted by law, Norsk Hjemme, its affiliates, licensors, agents, representatives, third-party services providers, and any of the foregoing entities’ respective officers, directors, owners, employees, agents, partners, contractors, representatives, successors, and assignees, will not be liable to you for damages, direct or indirect, extraordinary, exemplary, punitive, special, incidental, or consequential damages (including loss of data, revenue, profits, use or other economic advantages) arising out of or in connection with your use of this Site and/or our Services.
15.2 Notwithstanding the foregoing, if Norsk Hjemme, its affiliates, licensors, agents, representatives, third-party services providers, and any of the foregoing entities’ respective officers, directors, owners, employees, agents, partners, contractors, representatives, successors, and assignees are found to be liable to you or any other party for any damage or loss arising out of or in connection with these Terms, your use of the Site, and/or our Services, to the extent permitted by law, the total cumulative liability of Norsk Hjemme, its affiliates, licensors, agents, representatives, third-party services providers, and any of the foregoing entities’ respective officers, directors, owners, employees, agents, partners, contractors, representatives, successors, and assignees shall in no event exceed the greater of an amount equal to the fees paid by you to Norsk Hjemme for our Services.
16. Indemnity
The User shall agree to indemnify, defend and hold harmless, Norsk Hjemme, its affiliates and service providers, and their respective officers, directors, employees, agents, licensors, representatives, and third-party providers from and against any and all claims or liability, including costs and legal fees, arising from or in connection with your violation of these Terms, your use of the Site and/or our Services.
17. Force Majeure
Norsk Hjemme shall not be liable or be considered to be in breach or default of its obligations under these Terms to the extent that performance of such obligations is delayed or prevented, directly or indirectly, due to causes beyond its reasonable control, including, but not limited to, (i) acts of God, acts (or omissions) of governmental authorities, fires, severe weather conditions, earthquakes, strikes or other labor disturbances, floods, risk of kidnapping, war (declared or undeclared), armed conflict, acts or threats of terrorism, epidemics, civil unrest, riot, delays in transportation, or car shortages; or (ii) acts (or omissions) of the User. Norsk Hjemme shall notify the User in the event of any such delay.
18. Compliance with Local Laws
Norsk Hjemme makes no representation that the Site and its contents are appropriate or available for use in any jurisdiction. You agree that you shall obey all federal, state, and local laws, regulations, and rules that apply when you use the Site and/or our Services.
19. Access and Availability of Site
We do not guarantee uninterrupted, continued, or secure access to the Site. Part of the Site may be unexpectedly unavailable for whatever duration, and for various reasons that may include system malfunctions and disruption, Internet access downtime, and other technical problems beyond our control for which we cannot and shall not be held responsible. You agree that your use of the Site is at your own risk and that you will not hold us responsible for any damage or loss caused by your inability to use the Site for any reason whatsoever. We reserve the right to take any part or all of the Site offline for various reasons including but not limited to system maintenance or upgrading.
20. Termination
20.1 Norsk Hjemme shall be entitled to terminate the Services immediately if the User commits a material breach of any of these Terms where the breach is irremediable, or if such breach is remediable, fails to remedy the breach within a period of 15 calendar days after being notified in writing to do so.
20.2 Termination shall not affect any of the rights, remedies, obligations, or liabilities that have accrued up to the date of termination, including the right to claim damages for any breach which existed at or before the date of termination.
21. Severance
If any provision or part-provision of these Terms becomes invalid, illegal, or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this section shall not affect the validity and enforceability of the rest of these Terms.
22. Data Privacy and Protection
Norsk Hjemme endeavors to protect the security and privacy of Users’ personal data. Users of the Language Courses, namely the Group Courses, acknowledge and agree that Norsk Hjemme may make video and/or audio recordings of the Group Courses from time to time for the purposes of improving the quality of the lessons and for monitoring student experience. As this video and/or audio recordings may contain personal data, Norsk Hjemme will rely on Users’ consent and legitimate interests to process and store such data, and such data will not be held any longer than needed for the purposes for which it is held.

23. Modification
Norsk Hjemme may modify or amend these Terms at any time without notice. Such amendments are effective immediately upon publication on our Site or by notice by e-mail.
24. Waiver
No failure or delay by a party to exercise any right or remedy provided under these Terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.
25. Entire Agreement
These Terms constitutes the entire Terms herein and supersedes all prior or contemporaneous oral or written agreements.
26. Governing Law and Dispute Resolution
26.1 These Terms and any dispute or claim arising out of or in connection with its subject matter and/or formation shall be governed by and construed with the laws of Poland.
26.2 The courts of Poland shall have the exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with these Terms.
